Terms And Conditions Of Purchase
Section 1: Summary
ModMySite / MySiteGroup provides and licenses all of its programs, modifications, materials, and support “as is”. ModMySite / MySiteGroup does not warrant the operation of the programs, modifications, materials, and support to be uninterrupted or error-free. Estimates on time and funding required for programs, modifications, materials, and support provided by ModMySite / MySiteGroup, are estimates, and such estimates may require modification based on foreseen and unforeseen circumstances. It is the responsibility of the customer to perform backups and manage them, of their data, programs, and all other information both prior to, during, and after, any programs, modifications, materials, and support are provided by ModMySite / MySiteGroup.
Section 2: Reporting Issues
The customer must give proper notification of the defect or issue by opening a ticket in the ModMySite / MySiteGroup ticket system located at http://support.mysitegroup.com within 15 days of payment for the programs, modifications, materials, or support in question. All conditions that caused a suspected defect or error to materialize must be fully documented by the customer and be reproducible.
Section 3: Remedy Of Issues
If ModMySite / MySiteGroup determines that the defect was the result of, or related to, some action (or lack of action) by the customer, the lack of complete original specifications, or the need for additional time and/or funding to complete the modification or task beyond the original time and/or funding allocated, the remedy is at ModMySite’s / MySiteGroup’s discretion. In the case of the need for additional time and/or funding to remedy the issue beyond the original time and/or funding allocated, or to remedy some action (or lack of action) by the customer, or remedy the lack of complete original specifications, the customer maybe required to provide such additional funding before the remedy is performed by ModMySite / MySiteGroup. In the case of no or insufficient additional funding being made available to ModMySite / MySiteGroup by the customer to remedy the issue, ModMySite / MySiteGroup reserves the right to not implement such remedy.
Section 4: Obligation
In any case, the sole obligation of ModMySite / MySiteGroup, in the event of any defect or malfunction, is to provide programming and technical support, at ModMySite’s / MySiteGroup’s discretion, to correct and/or reasonably mediate the defect, under the terms of Sections 1, 2 and 3 above.
Section 5: Changes
The terms and conditions of this document may change from time to time as needed. By agreeing to this document, you agree to accept future modifications to this document.
